Terms and Conditions

1. Introduction
Welcome to Caption Magic (“App”), operated by Tiny Toad, LLC (“we,” “our,” or “us”). By downloading or using the App, you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the App.
2. License to Use
We grant you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.
Free and Pro use. In version 1.1.0, Free includes 20 successful caption/story generations combined and, separately, 20 successful Magic Background applications per local calendar day on this device. Pro removes these Caption Magic app limits, the export watermark, and in-app ads. Pro does not remove limits imposed by Apple, OpenAI, network connectivity, or the user's device, and does not guarantee uninterrupted generation. The purchase screen shows the applicable price and benefits before you subscribe.
Subscriptions and trials. Subscriptions are billed through Apple and renew automatically unless canceled. An introductory trial is available only when Apple finds the account eligible; the Apple purchase confirmation shows the applicable price, trial, and renewal terms. Manage or cancel through your Apple account. Apple's refund rules apply.
3. User-Generated Content
The App allows you to create images and captions (“User-Generated Content”). You retain all rights to your User-Generated Content. By creating content, you represent that you have the necessary rights to do so and that your content does not infringe upon any third-party rights.
AI generation in version 1.1.0.
Caption and story generation may process the image and text you provide using Apple Private Cloud Compute when available. When that service cannot complete a request, Caption Magic may send the image and text through its service to OpenAI, unless you have turned off OpenAI fallback in Settings. AI-generated results may be inaccurate or unsuitable; please review them before sharing. See our Privacy Policy for more about how this content is handled.
4. Acceptable Use
You agree not to use the App to create, share, or distribute content that:
- Is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
- Infringes upon any third-party rights, including intellectual property rights.
- Contains viruses or any other harmful code.
5. Termination
We reserve the right to suspend or terminate your access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties, or for any other reason.
6. Intellectual Property
All rights, title, and interest in and to the App, including but not limited to graphics, user interface, scripts, and software used to implement the App, are owned by Tiny Toad, LLC and are protected by applicable intellectual property laws.
7. Disclaimers and Limitation of Liability
The App is provided “as is” and “as available” without any warranties of any kind, either express or implied. To the fullest extent permitted by law, Tiny Toad, LLC disclaims all warranties, express or implied, regarding the App, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
In no event shall Tiny Toad, LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the App.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law principles.
9. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide notice of any changes by updating the “Effective Date” at the top of these Terms. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
